Fiery Semi Truck Accidents Results in One Fatality

According to a new annual report conducted by the American Transportation Research Institute and the Federal Highway Administration, the intersection of I-290 at I-90/I-94 in Chicago is the most congested freight-significant highway interchange in the country. The study found that the average speed through the local intersection during peak congestion is 22.34 mph while at non-peak periods the average speed was 31.89 mph.

The research conducted by the ATRI is done to determine the level of truck-oriented congestion at 250 highway locations around the world. Encompassing a variety of tools and software, the ATRI is able to obtain data from trucking operations to determine the congestion ranking for each location. This continuous research is a part of an initiative titled “Freight Performance Measures” conducted by the American Transportation Research Institute. According to the report, the FPM initiative examines techniques to assess the levels at which truck-based freight was affected by traffic congestion in 2010.

Trucking carriers have commended the efforts of the ATRI to help pinpoint the areas of traffic congestion that affect their drivers and shipments everyday. Cause of Highway Semi Truck Collision Remains Unknown

Last week, our Illinois semi truck accident blog reported a fatal semi truck accident that took the life of four individuals, including an Illinois semi truck driver. In the first news report, WCFCourier.com described the collision that transpired after a semi truck became disabled along Interstate 80. The semi truck was in the process of being assisted by two tow trucks when an oncoming commercial vehicle sideswiped the first tow truck causing a subsequent second collision with the disabled semi truck. The driver of the disabled semi truck, two tow truck employees, in addition to, the driver of the second semi truck died as a result of accident-sustained injuries.

In the following days since this tragic accident, the Des Moines Register published a follow up article discussing local authorities inability to determine the cause of the semi truck accident. During this investigation, authorities have checked into several factors to determine why the accident occurred. The following factors have been thoroughly examined, but have proven inconclusive:
- Witness statements from fellow drivers stated that there was no issue with the setting glaring sun that would provide for a potential distraction.
- The last text message or phone call the semi driver transmitted or received was seven hours before the crash.
- The 54-year-old truck driver that caused the collisions was within his maximum hours of service operation.
- The semi truck driver’s company uses electronic records for vehicle operation hours that cannot be misrepresented.
- No mechanical problems were found on or within the vehicle.

Another important key factor into the cause of this devastating accident could stem from alcohol or drug use. The news report states that the toxicology reports will not be available for several weeks. In addition, collision experts have been unable to determine the speed of the semi truck at the time of the collision. Crash investigators at the scene did note that there were roadway marks of tires skidding during the impact --- but no indication of brake attempts afterwards. It is unknown if this was due to the driver’s incapacitation or inability to take swift action.

Semi Truck Driver Cited After Cargo Accident

NTSB Recommends Rollover Prevention Systems for Semi Trucks

These recommendations come in light of the frequent re-occurrences of fatal semi truck rollover accidents. With over 1,300 commercial vehicle rollovers occurring each year, roadways all around the country have been put in significant danger for accidents resulting in injury or even death.

The NTSB recently conducted an investigation into the cause of a cargo tank trailer rollover accident that occurred in 2009. The semi truck was hauling a cargo trailer containing 9,000 gallons of liquefied petroleum gas when it overturned on an interstate highway. The rollover caused the truck’s trailer to detach from the vehicle – subsequently colliding into a steel guardrail. The collision caused the cargo’s gas to be expelled from the trailer, igniting into a fireball.

Through the investigation, the NTSB determined that the cause of the crash was directly related to the driver’s action to avoid a car in the neighboring lane. Crash investigators determined that the semi truck trailer’s high center of gravity contributed to the rollover accident. These types of rollover accidents have been a severe concern by the NTSB for over 40 years. Given that tankers do not permit driver error and are highly susceptible to rollover accidents, the NTSB recommends that new trailer regulations be implemented to help stop the frequency of semi truck rollover accidents.

Although the NTSB is not permitted to change legislation applied to large commercial vehicles, the Board does recommend that the Federal Motor Carrier Safety Administration, in addition to, the National Highway Traffic Safety Administration that would require all semi truck trailers containing cargo tanks exceeding 10,000 pounds be fitted with rollover stability control systems. Currently, two types of rollover stability control systems exist including Electronic Stability Control and Roll Stability Control. Each of these systems gives commercial vehicle drivers better control over cargo tankers in preventing jackknifes and rollovers.

National Transportation Safety Board Advocates Semi Truck Cell Phone Ban

This proposal stems from the recent investigation of a 2010 semi truck accident that resulted in eleven fatalities. The accident occurred when the 45-year-old driver of a semi truck crossed an interstate highway median and collided head on with a passenger van containing twelve occupants.

The collision resulted in the death of nine adults, a small infant, as well as, the driver of the semi truck -- with the only two small children surviving. Investigation into the accident concluded that the driver of the commercial vehicle has used his cell phone while driving for a total of 69 times for calls and text messages 24 hours before the accident. Further results showed that the driver had also made four calls in the minutes prior to the accident. The Safety Board determined that the probable cause of this semi truck collision was the commercial vehicle’s driver failure to maintain control of his combination vehicle due to mobile phone distraction.

According to the chairman of the National Transportation Safety Board, distracted driving is becoming increasingly prevalent … and can be especially lethal when the distracted driver is at the wheel of a vehicle that weighs 40 tons and traveling at highway speeds. Although the Safety Board does not have any legal power to change distracted driving laws for commercial vehicles – they do have the ability to advise other administrative agencies, The Board recommended to the Federal Highway Administration, Federal Motor Carrier Safety Administration, and the National Highway Traffic Safety Administration to outright prohibit the use of handheld and hands-free cellular telephones by all drivers of commercial vehicles during operation– except in emergencies.

Elmhurst Semi Truck Accident Results in Construction Worker’s Death

The 38-year-old victim was currently employed as a contractor for the Illinois Department of Transportation in Elmhurst when the accident transpired. Semi Truck Collision Results in Four Fatalities

Recently, our Illinois semi truck accident attorneys read a report on AZCentral.com detailing a multi-vehicle fatal semi truck collision. The initial accident occurred when the driver of a large commercial truck hauling a cargo of produce lost control of his vehicle and crossed the center median on an interstate highway – subsequently causing a collision with an oncoming minivan. The Federal Motor Carrier Safety Administration recently developed a system called Safety and Fitness Electronic Records (SAFER) System which compiles trucking companies’ safety data and related services for industry, as well as, public use. Through this concept, individuals are able to view the safety history for the companies of large commercial vehicles. This database details the amount of inspections the companies employees and vehicles has received, reported vehicle accidents for the past two years, in addition to, a safety rating.

According to the SAFER System, the trucking company of the driver who caused the initial collision maintains a satisfactory safety rating. Semi Truck Driver Indicted for Fatal Collision

Our Illinois semi truck accident attorneys recently read a report detailing a fatal semi truck collision that resulted in felony criminal charges against the commercial vehicle driver. The accident, which occurred early last year, resulted in the death of the 47-year-old female driver of a passenger vehicle –according to RecordPub.com. The semi truck, which was hauling a triple trailer, was traveling through a construction zone on a toll road when the driver fell asleep behind the wheel – subsequently colliding with the motor vehicle in front of him. The collision caused the passenger vehicle to in turn collide with the semi truck in front of it.

The driver of the motor vehicle was pronounced dead at the scene. The vehicle’s passengers, the woman’s two sons, were critically injured as a result of the accident. The 12-year-old son suffered critical head trauma that has left him incapacitated for life. Additionally, the 16-year-old son sustained a broken pelvis and facial fractures along with other injuries. The 49-year-old driver of the semi truck pleaded not-guilty to three felony charges. These charges included: one count of aggravated vehicular homicide and two counts of vehicular assault. The prosecutor in the case stated that the charges were filed as a direct result of an extensive investigation into the accident.

No Criminal Charges Filed Against Driver in Illinois Semi Truck Accident

The accident, which occurred on June 17 in Nelson, Illinois, resulted in the death of three individuals. Semi Truck Driver Charged in Fatal Accident

Earlier today, our Illinois semi truck accident attorneys read an article in WDay.com reporting a semi truck driver who has been criminally charged for causing a fatal semi truck accident. The accident, which transpired last December, occurred when the 65-year-old semi truck driver failed to stop at a red light at an intersection – ultimately colliding with a van carrying four occupants. The accident resulted in the death of the 8 and 5-year old passengers. The driver and the children’s father, as well as, his 3-year-old child sustained injuries that required a week long hospital stay. The semi truck driver has been charged with two counts of negligent homicide and one count of aggravated reckless driving. The driver has been sentenced to jail for one year with 305 days suspended. He will also be required to serve 18 months of probation, as well as, 100 hours of community service that emphasis on highway safety.

Collinsville Woman Killed in Semi Truck Accident

Our Illinois semi truck accident attorneys recently read a report in the Belleville News-Democrat detailing a fatal semi truck collision that took the life of a 48-year-old Collinsville woman. The female driver was traveling south on Illinois 111 near Pontoon Beach earlier this morning when her vehicle drifted across the center line into the northbound lanes. The woman’s vehicle was subsequently struck by an oncoming semi tractor-trailer. The 48-year-old driver was not wearing a seat belt at the time of the collision and she was pronounced dead at the scene. The driver of the commercial vehicle was not injured in the accident. Local authorities state that they will be performing a toxicology test on the deceased driver to see if alcohol or drugs played a factor in the accident.

Seat belts are one of the most important safety features in motor vehicles. These devices help prevent further bodily harm or even death in case of an accident. James Madison University recently conducted a study to determine safety belt use statistics. The study found that each year approximately 35,000 people die in motor vehicle accidents. Of those 35,000 people, about 50% (17,000) of these individuals’ lives could have been saved if they wore safety belts. In addition, when safety belts are used properly, they reduce the number of serious traffic accident related injuries by 50% and fatalities by 60-70%.

Illinois Woman Dies in Semi Truck Collision

Recently, our Illinois semi truck accident attorneys read a report in the Pantagraph detailing a fatal Illinois semi truck accident. The 21-year-old Odell woman died from the injuries she obtained as a result of a semi truck collision on Route 23. Local authorities state that the woman was turning left from Redwood Road onto Route 23 when she was hit by a semi tractor-trailer traveling northbound. The Peoria County Coroner stated that the woman died of multiple force injuries and toxicology tests are currently being conducted. The driver of the semi truck remained uninjured in the accident.

Chicago Semi Truck Accident Results in One Fatality

Recently, our Chicago semi truck accident attorneys read a report on MyFoxChicago.com detailing a rush hour semi truck collision that resulted in one fatality. A semi tractor-trailer was traveling northbound on I-394 when it crossed the center median and entered the southbound lane. Upon entering the southbound lane, the semi truck collided with a SUV. The collision caused the SUV to burst into flames resulting in the death of the 49 year-old female driver. While the initial cause of the accident remains unknown, authorities state that there was no indication that alcohol or drugs played a factor in the accident. Illinois police are looking into the semi truck driver’s logs to determine if the driver may have been fatigued at the time of the collision.

Every year, semi truck accidents kill over 5,000 people and injure nearly over 150,000 – according to SafeRoads.org. When a semi truck is operated by a fatigued driver, the risk for these types of accidents substantially increases. According to the Federal Motor Carrier Safety Administration, more than 750 people die and 20,000 are injured each year as a direct result of fatigued commercial vehicle drivers. Although the FMCSA provides federal regulations that limit the hours of services in which semi truck drivers are permitted to operate, often times semi drivers are pressured by their trucking companies to meet deadlines and arrive quickly at their destinations. In addition, many trucking companies give their drivers financial incentives to drive as many miles as possible in order to transport more freight.

The news report does not confirm if whether the semi truck driver is currently facing any charges or if the family of the deceased woman is seeking legal action. Driver Cell Phone Use Results in Illinois Semi Truck Collision

Earlier today, our Illinois semi truck accident attorneys read a report in the Chicago Sun Times detailing a semi truck collision that resulted in one fatality. Reports state that the driver of a passenger vehicle was using her cell phone while traveling along Illinois Route 53 when she collided with a semi truck. The women’s vehicle then proceeded to collide with a motor vehicle stopped in the left median of the northbound lane. The motorist of the stopped vehicle had pulled over to change a flat tire when he was struck by the woman’s car and subsequently pinned between vehicles. Although the accident occurred early last month, the motorist passed away today as a result of the injuries he sustained from the accident. The driver that caused the accident was cited for improper lane usage, driving on the shoulder, and texting while driving.

Cell phone use while driving has become an increasing epidemic that has caused a great number of motor vehicle accidents resulting in injuries and/or fatalities. The National Safety Council recently conducted a study reviewing accidents that occur as a direct result of cell phone use. The study found that over 28% of traffic accidents occur when drivers talk on their cell phone or send text messages. Of that percentage, 1.4 million accidents are attributed to cell phone conversations while 200,000 are blamed on text messaging. This type of distracted driving led to over 6,000 fatalities in 2008 alone.

Illinois has continued to provide a firm legislative stance against cell phone use during vehicle operation. Under current state law, driving in Illinois while using a cell phone is illegal for: learner’s permit holders, drivers younger than 19, school bus drivers, in addition to, all drivers operating in school or construction zones. Currently, Chicago is the only major city in the state of Illinois to outright ban cell phone use for motor vehicle drivers. In addition, the state also presently prohibits texting while driving for drivers of all ages.

Lawsuit Filed in Illinois Dump Truck Accident

Earlier today, our Illinois truck accident attorneys read a report in the Madison County Record detailing a recently filed lawsuit on behalf of a man who sustained serious injuries as the result of a dump truck accident. The lawsuit, filed in Madison County Circuit Court on August 22, charges seven counts against the dump truck driver, an Illinois waste company, in addition to, the company’s corporation. In the complaint, the victim alleges that he was traveling along Route 3 in Madison County when he came to a stop for a traffic signal. The defendant truck driver failed to adhere to the stopped traffic and collided into the rear of the plaintiff’s vehicle.

In the seven count lawsuit, the plaintiff alleges that the defendant negligently failed to keep a proper lookout, drove in such a manner that he collided with the victim’s vehicle, failed to control his vehicle, in addition to, driving in an inappropriate manner. As a direct result of the accident, the victim sustained serious injury including severe disability and disfigurement that has limited his ability to complete his usual duties. The suit seeks a judgment of $350,000 for medical costs and loss of wages, as well as, costs and other relief the court deems just.
