Dispute Over Punitive Damages in Tractor-Trailer Accident

A tractor-trailer accident claimed the lives of a family of four after the truck hit their passenger car causing it to burst into flames. The families of the victims have sued the truck driver for wrongful death resulting from the driver’s negligence and seek punitive damages (damages for pain and suffering). A local state law allows only the parents of the children to sue for punitive damages and therefore the counts involving the two boys would need to be dropped (because the parents of the child victims were killed in the truck accident as well), but many people are opposed to this logic and feel that it is unfair to deny the family the right to recover for the loss felt by the death of the two young boys.
