Wrongful death is legally defined as the wrongful conduct of a person or entity that results in the death of another person. In this case, the semi truck driver that who caused the collision is held liable for wrongful death on the grounds that he operated his vehicle in a negligent way that caused a fatal accident. Unlike personal injury claims, wrongful death lawsuits or claims are generally filed by family members of beneficiaries of the deceased. In addition, there is a strict statute of limitations that must be adhered to by family members in order to file a wrongful death lawsuit. In the state of Illinois, depending on the case, the statute of limitations for a wrongful death claim for truck accidents is usually about 2 years.

When a family member of the deceased brings a wrongful death claim they may be able to be compensated for a variety of damages. These damages include compensatory and/or punitive damages. Compensatory damages are intended to repay a victim’s family for the various expenses incurred as a result of an untimely death — while punitive damages are intended to punish wrongdoers for their negligent behavior.
