Driver Issued Citation in Semi Truck Rollover

Our Illinois truck accident lawyers recently read an article on KTVZ.com reporting a recent semi truck rollover. The commercial vehicle driver told local authorities that he was traveling along an interstate highway when he attempted to turn a corner and lost control of his vehicle. The semi truck veered off the roadway and subsequently overturned – causing the truck’s cargo of woodchips to expel from the trailer. Fortunately, no one – including the driver was injured as a result of the semi truck accident. Local authorities stated that neither alcohol nor drugs appeared to play a role in the accident. The driver has been cited for failure to driver in lane.

Although no one was harmed as a result of this semi truck rollover, more often than not, accidents in which a semi truck’s cargo is expelled onto the road has devastating consequences for the vehicle’s driver, property, as well as, all surrounding vehicles. When an 80,000 pound vehicle is operated, even the most minor driver error or distraction often results in injuries or even fatalities. Some of the most common semi truck driver error or distraction includes:
– Driver fatigue – Driving under the influence of alcohol or drugs – Distracted Driving (i.e. cell phone use)
– Poor Vehicle Maintenance (i.e. brakes, tires)

Semi truck rules and regulations are established by both federal and state governments to ensure the safety of our roadways. These rules are enacted to prevent the thousands of injuries and deaths that result from semi truck accidents each year. These regulations require that large commercial vehicle drivers adhere to a minimum standard of care when operating their vehicle. According to the Federal Motor Carrier Safety Administration, commercial vehicle driver standard of care is defined as the prevention of accidents by anticipating hazardous situations and adjusting driving behavior to compensate. Any violation of this standard may be grounds for negligence if an accident ensues.
