Earlier today, our Chicago truck accident attorneys read a report on TireReview.com detailing a fatal semi truck accident caused by an improperly secured semi truck cargo. The driver of a passenger vehicle was killed when a semi truck cargo containing a tire/wheel assembly became unsecured and collided into the 27-year-olds vehicle. The truck driver stated that the cargo assembly had been placed on the back of the truck’s flatbed trailer and was only being secured by one single strap. The truck driver disclosed that he noticed that the strap had become unhinged but could not pull over in enough time. The accident is currently still under investigation and no charges have been filed against the semi truck driver.
Each year, thousands of semi truck accidents are caused directly by improperly secured cargo. When a semi truck’s cargo is improperly secured, it is a direct violation of regulations provided by the Federal Motor Carrier Safety Administration. To protect against shifting and falling cargo, the FMCSA requires that trucking companies, drivers, and/or loaders secure cargo in a matter which prevents articles from shifting on or within, or falling from the commercial vehicle. All vehicle structures, systems, parts and components used to secure cargo must be in proper working order when used to perform that function with no damages or weakened components that could affect the vehicle’s performance.
