Lawsuit Filed Against Driver in Illinois Semi Truck Accident

Our Illinois semi truck accident attorneys recently read a report on the MadisonCountyRecord.com detailing a newly filed lawsuit against a semi truck driver for his role in a fatal semi truck accident that caused the death of a pedestrian. The accident occurred in late August when the victim was walking west on Chain of Rocks Road in Chouteau Township when she was struck by an oncoming commercial vehicle. As a result of the accident, the victim sustained severe internal bleeding and punctures to both of her lungs. The injuries the victim incurred unfortunately lead to her untimely death shortly after –leaving behind her two minor children.

A relative of the victim has filed a lawsuit against both the truck driver, as well as, his trucking company for their role in the fatal Illinois semi truck accident. The six count complaint filed on September 22 in the Madison County Circuit Court alleges that: the semi truck driver negligently failed to control and stop his truck to avoid the collision, failed to sound his horn to warn of his approach, failure to keep a proper lookout for pedestrians, in addition to, operating his vehicle at an excessive speed.

The complaint also includes the driver’s trucking company alleging that the company: failed to provide the defendant with adequate equipment, failure to equip the truck with adequate warning devices, failure to prevent the defendant from driving his vehicle too quickly, failure to install proper traffic signals to warn pedestrians of the truck’s approach, as well as, failure to install proper devices to control the defendant’s actions. Additionally, the suit alleges that the trucking company was negligent in hiring the defendant and failing to properly train employees to ensure the safety of others.
