55-Year-Old Construction Worker Killed in Illinois Truck Accident

According to Rockford Register Star Online, an Illinois trucking accident transpired earlier this week when a large commercial vehicle struck a construction worker on Interstate 39. Our Chicago truck accident attorneys read the article which detailed that the 55 year-old construction worker was performing repairs along the shoulder of Interstate 39 South when a semi tractor-trailer collided into the worker. Local authorities report that an Illinois Department of Transportation sign was directing traffic to merge into the left lane of the interstate highway, however, the 76 year-old large commercial vehicle driver was unable to merge in time. The accident remains under investigation and charges against the truck driver are pending.

Each Chicago truck accident lawyer at Levin & Perconti reads almost weekly reports of devastating semi truck accident involving roadway workers. Given the massive size and weight of large commercial vehicles, the consequences of these debilitating accidents almost always result in life-altering personal injury or even premature fatality. According to a recent study conducted by the Federal Motor Carrier Safety Administration, 150 people are killed annually doe to large commercial vehicle accidents in roadway work zones. A separate study by the Federal Motor Carrier Safety Administration revealed that 12% of all fatalities in semi truck accidents in the United States are non-motorists – including construction workers.

Although the news report does not confirm whether or not the accident victim’s family plans to seek legal action against the truck driver, through our experience as Chicago trucking accident lawyers, the victim’s family may be able file a claim of wrongful death in a civil court of law. Under current Illinois statute, a wrongful death claim is one where the death of an individual was a direct result of a negligent or unjust action. Additionally, wrongful death claims differentiate from personal injury claims in that the family of the victim files the lawsuit on behalf of the victim. In the case at hand, the semi truck driver’s failure to merge in a construction zone was the direct cause of the victim’s untimely death.
