Pedestrian Killed in Semi Truck Accident on Dan Ryan Expressway

According to an online news report posted by Chicagotribune.com, a pedestrian was struck and killed by a semi truck on the 83rd Street ramp of the Dan Ryan Expressway last week. A Chicago truck accident lawyer at our firm learned that the 40-year-old man was traveling northbound on I-94 and stopped along the right shoulder of the road near 83rd Street at about 9:40am. Authorities say he then exited his vehicle for unknown reasons.

A 1999 Volvo semi-trailer traveling in the right lane failed to notice the man and fatally struck him; he was later pronounced dead at the scene. The driver of the semi truck was uninjured, and no charges have been filed as of recently. The report states that Illinois State police closed three northbound lanes of the expressway in order to properly investigate the accident.

Although we cannot assume that the truck driver was to blame in this particular incident, from the perspective of an Illinois truck accident lawyer, accidents caused by negligent drivers of large commercial vehicles are causing an increasing amount of personal injury and fatalities throughout the state of Illinois. The National Highway Traffic Safety Administration (NHTSA) confirms that an increase in trucking accidents has occurred, not only in Illinois, but also throughout the country. Last year, a total of 927 fatalities took place in Illinois from trucking accidents, as compared to the 911 fatalities in 2010. This represents an increase of 16 fatalities, or 1.8%. In relation to nation wide statistics, there was an 8.7% increase in the number of people killed in crashes involving large trucks throughout the United States. These fatalities increased in all categories-large truck occupants, occupants of other vehicles, and non-occupants.

Although the above report does not confirm whether the pedestrian’s family planned to seek legal action against the driver of the semi truck, when pedestrians do suffer serious injuries as a result of careless or negligent motorists, they have the right to take action. If the semi truck driver was negligent, the victim’s family may be able to file a claim in civil court against the semi truck driver.
