Federal Judge Orders Truck Company to Provide Vehicle for Inspection

Earlier this year, a tragic fatal semi truck accident took the lives of six individuals after a semi truck crashed through a railway crossing and into an Amtrak train carrying over 200 passengers. The accident has spawned two lawsuits with both the train company, as well as, the trucking company filing suit against one another. According to a recent report posted by FleetOwner.com, Amtrak was granted a motion with the federal court which requires the trucking company to provide a truck for investigation that is the same make, model, and year as the one that caused the fatal collision in order to create a proper accident reconstruction. Additionally, Amtrak was ordered by a federal judge to give the trucking company video footage of the crash taken by an on-board train recorder.

In the federal suit filed by the railroad company, Amtrak alleges that the trucking company was negligent in training and hiring its drivers, as well as, maintaining the safety of their vehicles. Conversely, the trucking company asserts in their federal lawsuit that the railroads failed to maintain a safe crossing which aided in contributing to the fatal semi truck accident. The extensive investigation into the accident is also being conducted by the National Transportation Safety Board, but a final report into the cause of the collision will not be provided until early next year.
