Frito-Lay Sued by Their Driver in Connection to Truck Accident

A truck driver has filed a truck accident lawsuit in connection with a truck accident he was involved in back in 2007. According to the West Virginia Record, the complaint alleges that the truck driver was driving a truck that his company, Frito-Lay, knew had tires that were probably illegal and definitely unsafe at the time of the truck accident. Plaintiff is suing for costs incurred as a result of the personal injuries received due to the truck accident as well as compensation for any loss that workers’ compensation does not cover and well as other relief be may be entitled. The Defendant’s truck accident attorney claims that the Plaintiff is not entitled to any relief beyond what workers’ compensation is covering because there was no deliberate intent. Because the company is a Delaware Corporation (and the truck accident occurred in West Virginia) and the amount sought is higher than $75,000 the Defendant removed the case to federal court.
