Illinois Truck Accident Lawsuit Filed After Fatality

Filed in the Madison County Circuit Court, the lawsuit alleges that the defendant truck driver illegal traveled through an intersection – ultimately striking and killing their son.

The Illinois trucking accident transpired in December of 2009 when the accident victim was traveling east on Illinois Route 140 through the intersection at Fosterburg Road in Alton, Illinois. As the victim approached the intersection, the defendant truck driver attempted to make a left-hand turn from the westbound lane causing the subsequent collision.

According to the news report, the complaint alleges that the defendant truck driver saw the victim’s vehicle approaching the intersection in the eastbound lane but still initiated the left-hand turn through the intersection and across the eastbound lanes of Illinois Route 140 even though there was not a green traffic signal permitting his vehicle to make the ultimately fatal turn.

Additional components of the complaint assert that the truck driver negligently failed to keep a proper lookout, failed to yield the right-of-way, failed to stop or swerve to avoid a collision, failed to keep his vehicle under proper control, failed to obey a traffic control device, in addition to, attempting to make a left-hand turn even though it was unsafe to do so.

As a result of their son’s death, the family seeks a judgment of more than $200,000 for loss of love, society, companionship, support, services and affection … plus additional costs and other relief the court deems just.
