Semi Truck Accident Kills One And Injures Three on Eisenhower Expressway recently released a report detailing the death of a woman from Carol Stream after she pulled over along an expressway and was then struck by an oncoming truck. A Chicago truck accident lawyer at our firm learned that the accident occurred around 5:45am on the eastbound side of the Eisenhower Expressway near Kostner Avenue. According to Illinois State police, the 29-year old woman was parked on the shoulder of the expressway and exited her car for unknown reasons. The driver of an oncoming truck failed to notice the woman and suddenly struck her and her car, killing her upon impact and injuring her passenger.

The truck driver and his passenger were transported to nearby hospitals, in addition to the woman’s passenger. State police described all three as being in serious but stable condition. The woman was pronounced dead at the scene of the crash. The accident and investigation caused eastbound traffic on the expressway to be rerouted for about three hours. Charges are currently pending against the truck driver, as alcohol was believed to be involved in the crash.

From the perspective of our lawyers, accidents caused by negligent drivers of large commercial vehicles are causing an increasing amount of personal injury and fatalities throughout the state of Illinois. The National Highway Traffic Safety Administration (NHTSA) confirms that an increase in trucking accidents has occurred, not only in Illinois, but also throughout the country. In 2011, a total of 927 fatalities took place in Illinois from trucking accidents, as compared to the 911 fatalities in 2010. This represents an increase of 16 fatalities, or 1.8%. In relation to nation wide statistics, there was an 8.7% increase in the number of people killed in crashes involving large trucks throughout the United States. These fatalities increased in all categories-large truck occupants, occupants of other vehicles, and non-occupants.

Although the above report does not confirm whether the woman’s family planned to seek legal action against the driver of the truck, when individuals do suffer serious injuries as a result of careless or negligent motorists, they have the right to take action. If the truck driver was negligent, the victim’s family may be able to file a claim in civil court against him.
