Semi Truck Driver Faces Charges for Fatal Collision

A 59 year-old semi truck driver was charged earlier this week with vehicular homicide for his role in a devastating fatal trucking accident that occurred early last month. According to a news article posted on, the fatal accident occurred when the semi truck driver struck and killed a 40 year-old construction worker along an interstate highway. Despite the amount of time that has passed since the accident and the charges filed against the truck driver, our Chicago truck accident lawyers read that this was attributed to authorities waiting until a thorough investigation of the accident was complete. The truck driver faces the first-degree misdemeanor of vehicular homicide, the lowest charge he could receive with a commercial vehicle driver’s license although there was no evidence that the driver was under the influence of alcohol or drugs or use of cellular technology at the time of the accident.

In recent years, the topic of commercial vehicle accidents in construction or work-related zones along interstate highways has seen substantial increase with many resulting in injuries or fatalities. The Federal Motor Carrier Safety Administration recently released a study which found that an estimated 150 people are killed annually in large semi tractor-trailer accidents that occur in work/construction zones. These statistics comes as no surprise given the fact that these large commercial vehicles may weigh up to 80,000 pounds and a truck’s trailer may be up to 53 feet long. In an additional study conducted by the Federal Motor Carrier Safety Administration, it was revealed that in a majority of these trucking accidents – the commercial vehicle driver is the least likely party involved in an accident to sustain serious injury or fatality. Statistics prove that 74% of fatalities that result in trucking accidents are occupants of passenger vehicles, 12% are non-motorists, while only 14% are truck drivers.
